The Casablanca Declaration sends a contribution to Ms. Mama Fatima Singhateh, UN Special Rapporteur on the sale and sexual exploitation of children (see the contribution HERE). The previous UN Rapporteur has already recognised that surrogacy most often corresponds to child sale under international law definition, in a 2018 thematic report. This contribution once again warns against the situation of children born or to be born through surrogacy, as part of the theme “Protecting children from sale, sexual exploitation and sexual abuse: progress, new frontiers and the path forward”. – This contribution examines how all surrogacy contracts, whether paid or unpaid, treat the child as a commodity (I). – It demonstrates that this practice violates numerous international standards protecting children (II). – It highlights that surrogacy enables particularly serious violence against children, including sexual violence (III), – It calls on the Special Rapporteur to promote the universal abolition of surrogacy as the only means of effectively protecting women and children (IV). The Casablanca Declaration thus invites the Special Rapporteur to join the movement initiated by the Special Rapporteur on violence against women and girls, Reem Alsalem, who presented her report to the United Nations General Assembly on 10 October, calling on States to condemn surrogacy in all its forms and to universally abolish this practice (See HERE). |
