{"id":41485,"date":"2013-04-02T03:34:12","date_gmt":"2013-04-02T03:34:12","guid":{"rendered":"http:\/\/www.pressenza.com\/?p=41485"},"modified":"2013-04-02T03:34:12","modified_gmt":"2013-04-02T03:34:12","slug":"securisation-ou-insecurisation-de-l-emploi","status":"publish","type":"post","link":"https:\/\/www.pressenza.com\/fr\/2013\/04\/securisation-ou-insecurisation-de-l-emploi\/","title":{"rendered":"S\u00e9curisation ou ins\u00e9curisation de l &#8217;emploi?"},"content":{"rendered":"<p><strong><span style=\"font-size: small; font-family: inherit; color: #666666; line-height: 19px;\">Alerte lanc\u00e9e par des cabinets d\u2019expertise CHSCT :<\/span><\/strong><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">La transposition de l\u2019ANI du 11 janvier 2013 ent\u00e9rinerait un grave recul\u00a0du droit des salari\u00e9s et des pr\u00e9rogatives de leur CHSCT (1)<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">Les experts agr\u00e9\u00e9s aupr\u00e8s des CHSCT soussign\u00e9s souhaitent par le pr\u00e9sent texte faire \u00e9tat\u00a0publiquement de leur plus vive inqui\u00e9tude et de leur plus grande pr\u00e9occupation devant les\u00a0cons\u00e9quences que dessinent la r\u00e9cente signature de l\u2019ANI (Accord National Interprofessionnel) \u2013<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">le 11 janvier dernier\u2013et sa transposition en avant-projet de loi.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">Notre alerte porte sur plusieurs dispositions de ces textes pass\u00e9es jusqu\u2019ici totalement inaper\u00e7ues\u00a0et qui touchent pourtant \u00e0 certaines des pr\u00e9rogatives les plus importantes des CHSCT qu\u2019avaient\u00a0initi\u00e9es les secondes lois Auroux en 1982 :<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">&#8211; L\u2019obligation d\u2019information et de consultation du CHSCT en cas de projet\u00a0important modifiant l\u2019organisation, les conditions de travail, l\u2019hygi\u00e8ne et la s\u00e9curit\u00e9 ;<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">&#8211; Le droit \u00e0 l\u2019expertise du CHSCT.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">Le droit \u00e0 l\u2019expertise s\u2019est d\u2019abord impos\u00e9 dans un souci de protection de la sant\u00e9 et de la s\u00e9curit\u00e9\u00a0des salari\u00e9s. En cas de risque grave ou de projet important, les repr\u00e9sentants du personnel au\u00a0CHSCT peuvent choisir un expert ind\u00e9pendant agr\u00e9\u00e9 par le minist\u00e8re du Travail. C\u2019est par\u00a0<\/span><\/span><\/span><span><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">l\u2019analyse du travail que l\u2019expert va \u00e9tablir un diagnostic sur les conditions de travail et les\u00a0\u00e9ventuels risques professionnels auxquels peuvent \u00eatre expos\u00e9s les salari\u00e9s. Et c\u2019est \u00e0 partir de son\u00a0diagnostic et de ses pr\u00e9conisations que le CHSCT peut \u00e9mettre un avis sur le projet pr\u00e9sent\u00e9 par\u00a0la Direction. M\u00eame dans le cas d\u2019un projet national, chaque CHSCT doit formuler cet avis \u00e0 partir\u00a0des r\u00e9percussions locales sur les salari\u00e9s et sur leurs activit\u00e9s de travail.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">L\u2019ampleur et la gravit\u00e9 des modifications envisag\u00e9es par l\u2019avant-projet de loi r\u00e9sultent de plusieurs\u00a0amalgames (2) :<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">&#8211; Il dessaisit les CHSCT locaux de la possibilit\u00e9 d\u2019instruire eux-m\u00eames les projets, au\u00a0profit d\u2019une instance regroupant les CHSCT concern\u00e9s (1 seul membre par CHSCT, avec 20\u00a0membres maximum choisis par la Direction quand le nombre de CHSCT concern\u00e9s est\u00a0sup\u00e9rieur \u00e0 20 !) ;<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">&#8211; Il vide de son sens et de sa port\u00e9e l\u2019avis du CHSCT, r\u00e9put\u00e9 rendu \u00e0 la fin du d\u00e9lai\u00a0imparti, m\u00eame si les membres du CHSCT n\u2019ont pas eu le temps d\u2019\u00e9tudier le projet et de se\u00a0faire assister par leur expert. Or cet avis est essentiel, puisqu\u2019\u00e0 sa suite l\u2019employeur devra\u00a0prendre les mesures de pr\u00e9vention n\u00e9cessaires, sa responsabilit\u00e9 se trouvant engag\u00e9e eu \u00e9gard\u00a0\u00e0 ses obligations l\u00e9gales ;<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">&#8211; Il fait un amalgame entre les expertises CHSCT et celles r\u00e9alis\u00e9es par l\u2019expert\u2013comptable. Alors que ce dernier proc\u00e8de principalement par analyse documentaire, l\u2019expert\u00a0en sant\u00e9 au travail doit, d\u2019une part, r\u00e9aliser des entretiens avec les salari\u00e9s \u00e0 tous les niveaux\u00a0de la hi\u00e9rarchie et, d\u2019autre part, observer des situations de travail r\u00e9el en vue de produire une\u00a0analyse des risques professionnels ainsi que des recommandations. Tout cela prend du temps,\u00a0mais l\u2019enjeu est d\u2019importance : c\u2019est \u00e0 partir de ces analyses que les repr\u00e9sentants du\u00a0personnel argumentent leur avis sur les cons\u00e9quences d\u2019un projet ou d\u2019une r\u00e9organisation sur\u00a0les conditions de travail.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">(1) CHSCT : Comit\u00e9 d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">(2) En cas de projet de licenciements, il r\u00e9duit le r\u00f4le du CHSCT et confond ses\u00a0pr\u00e9rogatives avec celles du comit\u00e9 d\u2019entreprise. En effet la consultation du CHSCT ne\u00a0se ferait plus que dans le cadre temporel donn\u00e9 au comit\u00e9 d\u2019entreprise, ce qui r\u00e9duirait\u00a0m\u00e9caniquement le d\u00e9lai maximum accord\u00e9 \u00e0 l\u2019expert du CHSCT. Ce d\u00e9lai est actuellement de\u00a045 jours \u00e0 compter du jour o\u00f9 l\u2019expert est en capacit\u00e9 de travailler, ce qui se r\u00e9v\u00e8le souvent\u00a0un d\u00e9lai difficile \u00e0 tenir.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-family: inherit;\"><span style=\"font-size: small;\">Cette r\u00e9duction des d\u00e9lais aurait pour cons\u00e9quence in\u00e9vitable d\u2019emp\u00eacher une \u00e9valuation des\u00a0risques professionnels fond\u00e9e sur l\u2019analyse du travail r\u00e9el et conduirait \u00e0 des expertises au\u00a0rabais et standardis\u00e9es sans v\u00e9ritable utilit\u00e9 pour les CHSCT.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\"><span style=\"font-size: small;\">Dans un contexte actuel d\u2019intensification du travail et de r\u00e9organisations multiples et permanentes\u00a0\u2013 contexte marqu\u00e9\u00a0<\/span>notamment par une v\u00e9ritable explosion des risques organisationnels ou\u00a0psychosociaux \u2013, l\u2019utilit\u00e9 de ces expertises pour la pr\u00e9servation de la sant\u00e9 des salari\u00e9s et la mise\u00a0en exergue des enjeux de pr\u00e9vention n\u2019est pourtant plus \u00e0 prouver. Plusieurs jurisprudences\u00a0r\u00e9centes sont ainsi venues illustrer l\u2019importance grandissante de ces enjeux de sant\u00e9 au\u00a0travail, notamment en donnant corps \u00e0 la responsabilit\u00e9 de l\u2019employeur en la mati\u00e8re : on songe\u00a0ici aux milliers de d\u00e9c\u00e8s li\u00e9s \u00e0 l\u2019amiante ou \u00e0 l\u2019accident d\u2019 AZF, mais \u00e9galement aux cas de suicides \u00e0\u00a0France T\u00e9l\u00e9com ou \u00e0 Renault sans parler de ceux qui surviennent dans des entreprises moins\u00a0m\u00e9diatis\u00e9es. Rappelons \u00e9galement plusieurs arr\u00eats suspendant des r\u00e9organisations jug\u00e9es\u00a0pathog\u00e8nes suite \u00e0 des expertises (\u00e0 la FNAC, \u00e0 la SNECMA ou \u00e0 AREVA par exemple).<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333333;\">En l\u2019\u00e9tat, un tel projet de loi se positionne donc \u00e0 rebours de toutes les \u00e9volutions l\u00e9gislatives,\u00a0r\u00e9glementaires et jurisprudentielles qui, depuis les lois Auroux, n\u2019ont eu de cesse de faire\u00a0progresser la pr\u00e9vention des risques, la protection de la sant\u00e9 des salari\u00e9s et avec elles les\u00a0<\/span><span>pr\u00e9rogatives des CHSCT : il constitue une v\u00e9ritable remise en cause du droit des CHSCT \u00e0\u00a0s\u2019appuyer sur des expertises pour faire analyser le travail. Plus largement, il affaiblit l\u2019instance\u00a0CHSCT et remet en cause un acquis crucial en mati\u00e8re de pr\u00e9vention des risques\u00a0<\/span><span>professionnels et de protection de la
